Prenuptial agreements are particularly important for those who marry a second or third time, or for those who have acquired assets before the marriage.
The law establishes certain requirements that are important to fulfill in order to assure that these agreements are valid. An agreement may be declared invalid in the future if either party defrauded, coerced, lied or there was no full disclosure of assets and debts at the time of signing the agreement.
It is important to know that a prenuptial agreement will be valid even if only one of the parties hired an attorney to review the agreement. The fact that a party was not represented by an attorney is not a valid justification to set aside the agreement.
